To the Eagle:
I have spoken with my manager about the Eagle area
and have the following direction for you:
Since the eagle nest has been missing for several years, the Association
needs to contact US Fish and Wildlife Service to verify that the site is not on
the current eagle site list, or to have it removed from the list. If USFWS no
longer considers the nest site protected, there are no longer any Federal
restrictions on the site.
As for the County, if the 300-feet wide eagle reserve area is depicted on the
plat, or if it is referenced in the subdivision documents, they should be
revised to no longer require restrictions in this area (if USFWS releases the
site from the current list).
Revision of the plat will require a public hearing before the Board of County
Commissioners. Be reminded that any protected habitats (i.e., wetland) in this
area would still be regulated by this office, and may also have State
restrictions.
